You ask: How do you expect OZL(the defendant who claims no wrongdoing) is going to answer the question of "why should we claim?" - A from ozl is and should be: DONT CLAIM

While your question is rhetorical, it actually is a practical and important point, with potentially, significant implications for current investors in OZL. Let me briefly explain.

Point 1: I have already asked OZL what is their estimate of OZL's potential exposure to the class actions if they turn out to be sucessful, $100 million or what? It would be foolish to assume that the class actions have a non-zero chance of success, and therefore, OZL shoud inform the market.

Point 2: If OZL do not provide this information AND the class actions do prove successful in 2011, then current OZL shareholders might be doubly disadvantaged, leading to a 2nd set of class actions against OZL for not keeping markets informed of that potential exposure. OZL may be caught between a rock and a hard place on this one.

As OZL have themselves answered on DearCEO, we are talking about events in the short term and not far away. The Federal Court has ordered that a mediation of the proceeding be held prior to 30 March 2011. The case is listed for a directions hearing on 1 April 2011. A trial date has not been set.
