The court is NOT judging or imposing penalties on Neometals on those matters, only whether they played any part in making the applicants position redundant.
The court is basically judging if the Neo process of making the position redundant was done correctly, and imposing penalties & conditions on Neo IF the court finds it was not done correctly. Such as compensation, reinstatement etc.
