    The Con court did neither of those things and only sent it back to the DMR to review with no directives. I except the Bengwenyama-Ye-Maswazi Tribe are the owners of Nooitverwacht but its a divided community.

    It's interesting to note that Genorah approached the Bengwenyama-Ye-Maswazi Tribal in Feb 06.
    If they had no claim, why go to them. Agree with you here Kiwi thats why they didnt go to them for Eerstegeluk and the same arguement can be used against Bengwenyama-Ye-Maswazi with regards to Eerstegeluk, why apply for a land claim after your application if it was already yours

    Kiwi those two paragraphs was in my opinion was were Genorahs arguement was based as the Bengwenyama Minerals application only become a community 104 application on the 15 Semptember 2006 well over the required 180 days to challenge Genorahs over superior rights. Before that it was just a normal application by Bengwenyama Minerals in which Genorah had applied first.
