Stubbo, I haven't looked at the acquisition rules for a while, but as I knew it;
- any entity must disclose when they have more than 5%
- any entity cannot acquire more than 15%, with a 2% or 3% creep allowed, above the 15%, each year
- any entity looking to take over another entity cannot offer less than the maximum purchase price they have paid over the prior 6 months (this may not be correct, it may be 12 months).
So, to answer your question, an entity looking to take over another entity can purchase shares, but are subject to the above.
