So, to flesh that out...
The ALP purport to have made a merit's based decision.
In making that decision:-
1. The decision maker was not in possession of the technical advice of the independent regulator, NOPTA when making their decision.
2. The decision maker was not in possession of a Ministerial briefing from the Department when making their decision.
3. The decision maker willingly proceeded to publish the decision despite knowingly not following due process.
In my opinion, that meets the criteria to be considered corrupt behaviour.
It would up the NACC to adjudicate whether it is corrupt behaviour or not.
To the best of my knowledge, that process has not yet commenced.
