Not all legislation is “tested” in the courts nor does it have to be. I think what you are trying to say is the Secretary may be legally challenged as to whether he/she has used the new power appropriately. For that to happened, he/she would have to use the new power in a way the is deemed challengeable. And note the Secretary has other powers under the Act that are very similar to this power.
