-ASIC does indeed have to make its case and it is contained in the Statement of Claim, which is clear and unambiguous. It may be open to Money 3 / Solvar to disprove the evidence that ASIC has put forward. If so, there is going to be major fireworks IMO
-The Credit Licensee has ultimate responsibility for granting a loan. If the source of the loan is a broker, they must also be licenced and conduct themselves in keeping with the Act, but ultimate responsibility lies with the Licensee
-The Credit Act is prescriptive. The Licensee is responsible for the conduct of its employees
