My point is that given their position (running low on cash and constantly tapping an ATM for the past 11 months) a smarter/experienced management team would have played the game to use the NBIO's to support the share price and put some confidence in demand for the project. If you're getting offers you don't want to take, at the very least you can advertise that fact to the market in a timely and excited manner; lots of companies play the game this way.
Bad disclosure doesn't mean they're breaking ASX rules, just they've been about as clever as a bag of rocks.
