I am fairly certain we won’t see the application submitted to Planning Secretary. This the first application after the amendment to the legislation to my knowledge but I will check recent SSDs and let everyone know if I find anything about the process being used.
And as discussed before the Planning Secretary is not responsible for re-determining the application.
It all hinges on whether the Planning Secretary’s decision is that the transmission line is part of a single SSD or not. That will determine how SVL proceeds with the re-determination.
Couple of other things:
SVL have always stated they were continuing with the 66Kv transmission line. It appears, however, they are able to undertake the mine construction using diesel generators as mentioned in the Optimisation study. So the need to commence the transmission line might be later in the mine construction timeline than first thought.
In terms of any appeal, the action group may be able to appeal the Planning Secretary’s decision but that would have nothing to do with SVL. And it’s unlikely they could start any action until the project had its approval reinstated.
