The issue, as I see it is that this is the first time anyone has heard about it.
CE has in the past said there is no ability for MS to get their initial 1.1bil back.
We can all argue the toss about what this clause actually means, but we still don't have the document or proper disclosures. Its another credibility issue for MIN and CE. Additionally, it's a new risk that could tip MIN into admin if MS so choose. I have no idea how they might feel, about everything.
