I suspect that this wouldn't be a major hurdle to remedy, plus they would be able to employ a fire rated walling system to comply with Aus Standards as the construction progressed. Check out: Fire Resistance Ratings (FRL)
Looked to be adjoining shared wall construction so it must have been resolved to be compliant before works commenced.
