Decision

Having considered the information available, the Minister accepts the Appeals Convenor’s recommendations and decided to allow the appeal in part.

The Minister considers the EPA’s assessment was adequate, consistent with the policy framework, and that implementation of the proposal can proceed without further assessment.

The Minister also accepts the Appeals Convenor’s recommendations to amend conditions addressing dieback (Phytophthora species, primarily P. cinammomi) to help mitigate the potentially significant impacts to native vegetation within and surrounding the proposal area.

The Minister has arrived at the decision having considered the Appeals Convenor’s report, responses to the appeal from the EPA, the proponent, the appellant’s additional submission and advice from the Department of Biodiversity, Conservation and Attractions.

The Minister has otherwise dismissed the remaining grounds of the appeal
