As we are approaching THE critical stage of PEP11 - I thought it would be wise to post relevant documents/passages/paragraphs related to PEP11 'decisions' over the past 5+ years.

I will not make any comments but will highlight the docs as appropriate.

NOTE1: These docs are primarily for Application 1 (Jan 2020)

NOTE2: The reasons given by ED is FINANCIAL and PUBLIC INTEREST to REFUSE PEP11 in Jan 2025.

I believe there are 4 documents/paragraphs that are relevant:

DOC1: NOPTA Recommendation April 2020 - APPROVE



DOC2: "Asset's variation request is reasonable and is in accordance with the Act and the Guidelines"



DOC3: Financial Capability - Pathfinder Precedent



DOC 4: Departments Advice (not NOPTA) regarding Public Interest




AND FINAL NOTE:
As advised by DB in an Announcement this year - NOPTA has again recommended Approval of PEP11 applications to the Minister (ED at the time).

So here we are.... I believe these 4 docs show the status of Assets application to the Federal Court and the basis of why the JA decision will be 'quashed' (MY OPINION!!)

At the end of the day -

1. It is up to Fed Govt to decide to go to court (OR NOT) on 16/17 Sept
2. It is up to Justice Jackson - should it get to court - to make his decision....
