Andiver, the Minister did not back Amakutuwa. He was merely a respondent in the appeal lodged by MLS in the Namibian Supreme Court. No one represented the Minister and he is obliged to abide by the decision of the Court.
In the High Court proceedings, Amakutuwa was the applicant and MLS and the Minister were respondents.
