I don't buy this statement:-
"It would be pretty easy to show that NXS were unable to pay per the Trans contract terms"
It will be necessary for Transocean to prove that if the contract had proceeded that NXS would have been Insolvent. IMO they will fail miserably to achieve this as there are far too many uncertainties in what may have happened and the onus will be on Transocean to satisfy the Court. They have Buckleys IMO. This is a long shot at best!
