I am pretty sure that APG had a hint of possible issues with the transaction due to the Astron/AZC history and I thought there was something in the contract between Astron and APG to indemnify APG against costs.
The whole thing really is not of issue now.
When APG needed the money 18 months ago it was a HUGE issue but now we have Kronos.
If we win its $5.0m in the bank.
If we loose we still have an asset worth more than $5.0m and I am sure there are buyers on the sideand we will have the money sooner or later.
The real focus is on the plant construction, commercialisation, generating a cash flow and working out what KRONOS want post construction (all of it is my guess) and what the other majors who are waiting on the sideline want.
