The Highlights!
As of September 9, 201l, although Marion has advised the Division that it has
performed MITs on three wells, these tests have not been confirmed, and it remains in violation of the Stipulated Order to plug the wells or bring them into
production.
9. The Division finds that the following wells remain out of compliance with the
Stipulated Order:
Utah Fuel 1
Utah Fuel 2
Utah Fuel 3
Utah Fuel 8
Utah fuel 10
Utah Mineral State
Oman 2-20
10. Some of these wells may be claimed to be an essential part of a field development,
but Marion has not shown any potential for these wells to be viable as part of the
field or singularly.
1 l.Marion is the designated operator for five other wells in the immediate geographic
vicinity of the subject wells. None of these wells are viably producing and each
well is dependent upon a defective water pipeline. The pipeline is crucial to
Marion?s operation because it allows the company to economically transport water
removed from the subject wells to an injection well for disposal. Previously,
Marion depended on trucks to haul the water away, but determined that it was too
costly. Pursuant to Board approval the Alpine School District 3-17 well was
converted to an injection well and Marion received the necessary permits from Carbon County and the federal govemment to construct the pipeline. However,
the pipeline began leaking over the recent 4th of July weekend and the Utah
Department of Environmental Quality recently issued Marion a Notice of
Violation. The Division has ordered Marion to cease operations until the pipeline
is capable of operating without damaging the environment. Currently, the pipeline
is not operational.
12. Both Carbon County and the federal agencies have identified Marion as being
noncompliant with their permits and are pursuing independent administrative
actions.
