I dont think it will be too late if we just wait a little longer to see how it will play out. If say, the TO is successful, it will still need to get approval from ASIC first, so if we would make a complaint then, ASIC will still review it.
Yes, I agree with you that we need to protect SH interests from the fact that if this TO is successful. However, there is still a chance that majority of the votes would reject the offer and Lion coming back for a re-bid. I checked the recent share registry top 20 holders on SBL's webpage and it seems its not that difficult to overcome the holdings by Infinity and SBL mgmt (assuming that these other top 20 holders have the same opinion as us here in HC, which is not too difficult to imagine)
