DOC spokesman Rory Newsam said DOC was
still processing Bathurst’s concession and access
applications for the mine. A final decision was some
time off.
However, before DOC could grant a concession
for the mine it had to formally notify its intention to
do so and call for public submissions, said Mr Newsam.
The public would have 40 working days to make
submissions and the department would then
hold public hearings, he said.
“DOC must take these submissions into account
before making a final decision on whether or not to
grant a concession to the company.”
DOC was not required to notify the public when
only an access agreement, but not a concession,
was required for mining on conservation land.
In the Denniston case, and with most significant
mines, if there was a concession agreement public
consultation was required.
If DOC wasn’t intending to grant the mining concession,
no public consultation would be required.
