It's true that the NTMA announcment didn't specifically say anything about the M&DC case, but it did quite clearly say that they had reached a settlement, and one of the coditions was filing a NTMA. That definately doesn't make it obvious that there are no larger ramifications to the settlement.

So we're left with it being unknown unless you can fill us in straight from the CEOs mouth... It sounds like you have called the company and talked to the CEO. If so, did he actually say straight out that there is no settlement to the M&DC case?
