But Anglo wont settle without ARM. Even though ARM doesn't seem to have a direct case against NKP or DMR. Because ARM would have a case against Anglo.
It would be like me (ARM) buying a house (Modwika JV) off you (Anglo). I later find out you didn't own the house. Now I'm left with no house through no fault of my own. I cant sue the real estate agent but I can sue you.
Or maybe you did own the house but in joint names with your wife? and you sold it without her consent?
Under that scenario NKP is the innocent. They lawfully bought the house off the correct owner.
That basically sums up why Anglo and NKP need ARM to agree to a deal.
But its much murkier why Anglo alone or Anlgo/ARM feel they have a case in the first place. Are they confident of iregularities in the awarding of the rights to NKP? Certainly DMR aren't reassuring us in any way.
Is their case that they withdraw their application on grounds that NKP would 'enter into commercial agreement'? And NKP have failed to live up to that end of the bargain.
It's a mess. All the parties no it. Sth Afr is a basket case.
I'd love to know which minerals we have rights to. Beng claim to have the gold rights but went quiet. It would be a pain if we only had PGM and other companies start getting under our feet.
