JJ - yes indeed... sorry if this is a rehack of other opinions, but mine is that there is zero chance the court could decide the AELB were unjustified, somehow got the decision wrong or didn't follow due process... it's a nuisance case. It just depends how far the court wishes to entertain the case and how long the process takes - do they need to string it out to show due diligence so as to avoid outcrys that the legal system is somehow biased to the govt or at the other extreme do they want to dismiss it outright to make a point that such timewasting ie using the legal system to make futile political points is not to be tolerated?
