    SS - there is nothing new about this.

    The potential for a year-long Hearing process delay became manifest last July when NRC advertised the "opportunity to request a hearing and to petition for leave to intervene, and Commission order".

    The July 13 advert clearly stated the following:

    "Those permitted to intervene become parties to the proceeding, subject to any limitations in the order granting leave to intervene, and have the opportunity to participate fully in the conduct of the hearing with respect to resolution of that person's admitted contentions, including the opportunity to present evidence and to submit a cross-examination plan for cross-examination of witnesses, consistent with NRC regulations, policies, and procedures. The presiding officer will set the time and place for any prehearing
    conferences and evidentiary hearings, and the appropriate notices will be provided"

    Anyone troubling themselves to spend an hour or two on NRC's website could easil;y have found out what the intervention/request for hearing process entailed in terms of process and time.

    The potential for a Hearing delay increased dramatically on 10 Feb - when standing was granted to the petitioners. I provided details of what the decision entailed (in the event that an appeal was not lodged or lodged and lost) but was shouted out of the room.

    Last night's Adams posting has merely confirmed what was likely to happen. There was nothing 'goal post changing' about it. It only appears that way because so many have sought to ignore the issue or trivialise its importance.

    After 9 months of positioning by the respective parties (since the Jul 13 advert) we are now at a pivot point with respect to the SML. There are only 2 possibilities - a successful appeal and return to the late-2013 permit issuance timetable OR a lost appeal with a 12 month delay to late 2014.

    My money is on a successful appeal - but it is far from a 'lay down misere' as some here are suggesting.
