The transcript of the 28 March meeting also included a few clues in regard to the appeals against the hearing/petition to intervene.

Here are the relevant comments from JUDGE BOLLWERK:


"In terms of the balance of the schedule then one thing we will assume for the purposes of this schedule, and I recognize that there are appeals pending filed by both the Applicant and the Staff, and obviously the Commission will dispose of those as the Commission does. And I would hope certainly they would be able to get to them before the draft EIS is issued, which is towards the end of the year and hopefully, perhaps, a little earlier than that. But again that's something that's up to the Commission in terms of how they handle those.

But for the purposes of this discussion we'll simply assume that the contentions as the Board admitted them will go forward as well as the Joint Interveners having standing and we'll talk about it in that light"
