I have looked at the patent that is currently held on the process patented by the Plaintiff and believe the LIT process may be sufficiently different to avoid infringement of the innovation patent. The interesting thing is that the Plaintiff has bought an action on a patent that at the time of commencing the action, was unenforceable as the patent is still under examination. IMO the patent examiner will significantly reduce the scope of the claims in the innovation patent as the claims are sufficiently broad as to potentially restrict others from processing ore for other processes. Similarly the international patent has a very large number of claims which if challenged could see the Plaintiff lose some of the claims.

I am not an idustrial chemist but I have experience in IP law and IMO the Sileach process appears to be sufficiently different based on what is in the public domain.
