It is just a thought experiment. I am sure that MM and the board would never mislead the shareholders.
Unfortunately the history of the ASX does suggest that nobody would end up in court for misleading shareholders. Just go and have a look at history of BIG Unlimited where the CEO mislead shareholders on a massive scale by pretending loans were sales, losing the shareholder hundreds of millions of dollars. He has not been charged.
