The High Court has upheld the original decision made by Judge LJ Newhook in the Environment Court that, in considering the applications for resource consents for the Escarpment Mine Project the Court cannot have any regard to the effects on climate change of discharges into the air of greenhouse gases that might arise from the burning of coal.
