    Section 4.3 is clear and doesn't state that akq.

    4.6 states that the shortfall will be placed "at the discretion of the directors" in consult with Hartleys. Does this mean you can apply for shares in the shortfall? That I am not sure but I will be clarifying as I would if I could.
