Don't think Tensor would risk being sued over this.
If they do it and once the word gets out, in the corporate world, it is hard to get clients when trust is broken. Plus, will have to pay big $$ in damages and possible confidentiality and patent breach etc.
From Tensor's perspective, not worth taking that risk (for intel) imho.
