Just watching Bloomberg and ‘L.A. Prosecutors have announced an in-depth probe into short selling in the US and the relationship between Funds and Analysts to the applause of small retail shareholders’.
The suggestion being that Analysts will at the behest of Fund Managers engaged in short selling produce reports designed to collapse the shorted companies share price. The in-depth probe/ investigation arises from the initial examination appearing to support the claims of small retail investors that this is occurring.
Having a background in the prosecution and defence of persons engaged in acts of dishonesty it is a fundamental principle of sentencing that an act of dishonesty is considered to be more serious and deserving of greater sanction where the act is a systemic course of conduct executed on a continuing basis. An impulsive one off theft of say $10,000 will be seen as far less serious than an ongoing series of thefts of $10.00 from the same or different persons totalling $10,000. If the theft arises from a position of trust and privilege it will be considered as even more serious.
Being in the privileged position to short a share such as Brainchip and then engaging in multiple acts to create a false market will be viewed as a very serious offence.
The action of bodies such as the L. A. Prosecutors will if they uncover and successfully prosecute those involved will lead to similar investigations elsewhere.
In my opinion only the sooner the better.
