There's already been discussions regarding how you can't hide market material information behind an NDA. Specifics of the agreement (such as initial fee, per unit fee) will be kept in confidence (as you don't want other customers using that as bargaining leverage), but Mercedes (by way of example) can't require BRN to keep a license agreement under wraps to preserve some sort of market advantage. In fact BRN has already been asked to disclose an EAP (Ford) because the ASX wasn't happy with the level of disclosure. BRN has to meet their statutory obligations and no amount of NDA can avoid that. An NDA/CA constitutes a form of contract or clause to a contract - first rule of a contract is you can't force someone to break statute by way of contract (extreme examples - I can't contract you to kill someone, or claim an NDA you signed with me prevents you from talking with the police about a crime you witnessed me commit)

Of course, as the company grows and the relative importance of each license agreement diminishes (For example, BHP doesn't disclose every single supply contract they win) - the requirement to disclose will also change.
