Positive Court of Appeal Decision for Bathurst
Bathurst Resources (New Zealand) Limited ('Bathurst' NZX/ASX: BRL) is pleased
to advise that the Court of Appeal has today declined the application by
Royal Forest and Bird Protection Society of New Zealand Incorporated ('Forest
and Bird') for special leave to appeal the decision made by the High Court on
the relevance of the Sullivan Permit in relation to the Resource Consents for
the Escarpment Mine Project.
In June, Forest and Bird made an application for leave to appeal the High
Court's Sullivan decision. This was declined at a hearing on 12 July 2013.
An application for special leave to appeal was then made directly to the
Court of Appeal on 2 August 2013. Bathurst opposed the application.
Bathurst Managing Director, Hamish Bohannan, said "This is another positive
decision for Bathurst and we now look forward to receiving our final
approvals to allow work to commence on the Escarpment project."
