Ibb, not a lawyer and Brisen could elaborate, however, the principle is, I believe, that reliance on a position can be eroded (estopped) by one's subsequent actions. No point in discussing til we see what the Expert comes up with. I note that Brisen has been confident of him delivering a positive outcome for PLS and I also note they engaged Senior Council to deliver the amended Sales Notice, being well aware there would likely be an Expert Determination.
