Does this lead then to the fact that the 'company' cannot be sued but only the management? - the management being the ones that have acted in someway that have impacted adversely on the 'company'. So which is the entity we invested in - the company, or did we invest in the management? And then with OZ we have the case where management have done a bunk elsewhere (thank goodness), so will it be the case that it is the old management that should be sued or does the new management suffer that fate even they they had nothing to do with the reason for the litigation.
Seems like there a lot of grey areas in this for lawyers to have their picnic.
