They are legally unable to. This CR takes the amount of shares to be issued to another 12.5 - 12.7%. They can only issue an additonal 15% in any 12 month period without a shareholder vote, for which they need to issue documents, have meetings, etc - very embarrassing, given the circumstances. They already reported that staff are now getting cash bonuses instead of stock options, so that might tell you something too.
After the cashflow report and financials have been issued they are likely to do a bigger CR IMO, but not before going through the proper procedures
