Have a look at the share price change on Oct 26th. The patents held by 4DS are exercisable globally because they are Australian owned however if purchased outright by a company inside the U.S for example, are only effective inside the U.S. The same applies to the U.K and Europe. WD pulled their interest in Kioxia the same week they were at the table in Belgium with IMEC. It wasn't a decision solely influenced by Hynix objection either. A straight out sale of 4DS is probably not the best outcome for shareholders, directors or for a company like WD, if indeed they are in the seat. A more realistic scenario would involve 4DS remaining intact and the parent will be the new memory division of WD. WD would still want the Kioxia deal to go ahead but they need a new angle to get it across the line. If the new tech is scalable and can be tuned accordingly, It wouldn't be out of the question to then proceed to offer 4DS shareholders a buyback/stock split scenario, probably around the $2.35 mark. If the new division at WD floats at even $5, that's a good outcome. You'll probably find a trading halt will be requested next for 4DS, an offer will be put to shareholders, it'll either be accepted or rejected but most likely accepted and the company will change hands. It won't take 12 months. I think if you've invested your hard earned with this company because you believe in what they are doing and waited patiently as so many of us have, removing the emotion - you have to have a level of faith that they are experienced enough together with their legals who are well versed in M&A to bring the best possible deal home for all players. Full disclosure - I have a significant holding and will be at the meeting in sunny Perth.

2. do you believe it's good to vote in favour of increasing shares or not as has been asked by the BOD ...?

I was initially against voting yes but have changed my mind reading some posters feedback.

3. what do you think the company /technology could potentially be worth to other large players ?

4. do you believe there could be a bidding war or we kind of more stuck with WD due to the long time partnership?
