Hypothetically if they had been told the deal is not going ahead, I suspect they would be quite sensibly spending their time trying to resurrect it. Are you proposing (if this hypothetical is true) is that the first thing they should do is inform the market and resume trading at circa 9c instead?
As for emailing him every other day - what possible benefit are you hoping to achieve? He legally can't tell you anything of substance and even if he could, what would you do with it? If I were a shareholder I would ask you to stop distracting him from his job at possibly the most critical time since the company listed.
