IMHO, the shorting of stock should be challenged in court (I wish I have the resources to do this) as I feel the case can be won straight away. The reason is Stock is like any other capital investment, such as an investment property, which is subject to normal capital gain tax. If I rent my property, does it give right to the tenant to sell my property and buy back later with a lower price? Will any court allow such practice? If it cannot be allowed in other investments, why should it be allowed in stock?
