Have a look at the definition of the "exclusivity period" as outlined in the amended SIA
Then have a look at clause 14 in the amended SIA ....."during the exclusivity period, Sundance will promptly enforce the terms of any confidentiality agreement entered into with a party other than Hanalong in relation to a competing transaction"
Clause 14.6 does allow Sundance to enter into discussions with competing bidders....at least that is the way I understand it
What does all this mean.
The amended SIA allows Sundance to entertain other offers whereas the original SIA did not allow for that to happen ... I stand to be corrected
I spoke to Sundance today and was told to read this clause in the amended SIA
From where I sit I am definitely not selling
