The licensing arrangement with WD also includes a right of first refusal on any takeover offer made by a third party.
If Micron (for example) came to the party and said, "we want to pay 3 billion for the company," 4DS would go on and notify WD of the offer. WD can then elect to buy at the same price if they want, or exercise their right to an IP license if they decide that is too much.
