It seems to me they are already buying time from the "extensive and time consuming" comment re testing.
If they were desperate, they could always say they want to prove that the chip BEOL process is repeatable for any purchaser and buy them another three months to nut out a corporate transaction whilst they reperform the chip.
But yes, that's a little thin considering the test chips would be made and ready to go, and the BEOL process is not the complex part.
