    4DS memory were very clear "free from any royalty and or licensing obligations"
    Western Digital may still have the option to purchase the 20 year non-exclusive license, however 4DS Memory is not obligated to honor that option unless its a premium and good for 4DS Memory and it's shareholders.

    Best case for 4DS Memory is to sell the 20 year non-exclusive option to Western Digital and then enter into a commercial transaction (acquisition) with the likes of Samsung, Micron, SKhynix or Intel.
