Nothing we can do about it, WD has rights, but they will have to pay a royalty fee, or could potentially sell the rights on.
I hope this tech doesn't end up exclusive, we don't need Apple / Intel / Samsung with a monopoly.
However until a working PL6 arrives, we can only dream, why we sit at 10c.
