My read of the ASX ANN is that they may "at their absolute discretion" vary the amount sought, so they may go over the $40m to ensure every sholder gets their maximum they ask, Aust retail investors do not fully subscribe, STO demonstrates this with their SPP.
Otherwise retail Australian resident sholders may have a claim under the minority interest rules regarding EIG IMHO but pls DYOR. It seems to have stabilized under the 39-40 cents level.
I think they will be more dilutive to some of us ineligible sholders and just allow for more capital so every sholder who subscribes up for shares up to $15K AUD gets their full allocation.
It means more rigs and wells so the dilution is OK. It would be hard to take issue with it and everyone has until March 1 2017 in any event.

I agree with JCOURE, everyone who applies for $15k will get their full allocation, i don't think there will be a scaleback to the $40m.... so only apply if you want to hold an additional $15k shares.
