Remember the best Arbitration Settlement which starts in a couple of weeks will be a higher royalty based on increased production capacity and sales. Win win for all. GSK pays out from funds as they come in - more $$$'s for BTA because they are not all up front.

Bripat you could well be right that such a clause would be used to have a face saving effect for all parties involved.
I would be happy to see this happen.
Time will tell but we have now the beginning of a tremendous upside not thinkable by most even 3 weeks ago.
I had seen the writing on the wall for a while now and I knew that the resistance in tamiflu and the fact that they can not keep up production would benefit Relenza.
Now we have reached that point and the flood gates are open.
We can no expect huge orders for Relenza that would have been unheared off only 4 weeks ago.
Vaccines are a long time off and in the meantime Relenza will be produced by GSK in newly opened plants around the world.
In the meantime as you say a new approach to royalities from GSK could well be on the cards to solve the litigation problem.
