Molly good post but really believe that direction given by a judge are of lost on a jury especially when a case like this will go so long jurors who are there for longer than a week form there own opinions. It has been proven in many studies on juror behavior. As a person to hear a case Finkelstein is probably one of the fairest and in a settlement believe both parties will be able to save face. Thats why I really think a 60/40 confidental offer will be considered as fruitful and generous after so much time would really not like to be the party that passed on his suggestion what he thinks as fair and reasonable.
