I'd hate to be a patent lawyer trying to work out who has rights to different patents and it may come down to the usual case of the person with the most $ wins.  Company that has installations and is generating commercial cash flow may have a distinct advantage and may have had it's patent security assessed by purchaser as due diligence.  I see a lot of $ getting sucked up in defending patents or acquiring lic for others.
