Solvar was prosecuted using a sample of 5 loans as is common practice. There could have been thousands - you, I and nobody else could know, but it would not be practicable or expedient to tie up years of Court time arguing the toss over large numbers of cases. If Solvar had the correct processes in place at the time to successfully defend the charges it would have been simple to do so. ASIC stated that it did not, which is equally simple to prove as the Act and its requirements are very straight forward.
