IMO this announcement from the 19 July 2012 isn't quite all that accurate then is it....

Add to that the 6 erroneous FORM 604 notices of last week.

Changing my sentiment to "we're screwed". Only 75M shares required to take it private...and given the seemingly hazy memory to date of who owns what and who is associated with whom, could IMO possibly be there already.
