Hi Fisho. You're not likely to see any information on HC that is based on facts around what the paperwork does or dosent say. I think Hotazel has raised this point several times and I think he believes that most contracts these days do make preemption possible if someone sells an entity...... there have been a couple of recent examples posted on here. I think the answer lies in your post. COP have said that FAR had/have preemptive rights. I think the sticking point is more around what FAR have not been told both WPL,COP,CNE have intimated that there is commercially sensitive information that they don't believe FAR needs to know. Now I'm not sure about you Fisho but I would never buy a house without a building inspection....... never buy a company without a look at the books. I think this is the nub of the PE issue.
You raise an interesting point about FAR making a fuss.
Do you honestly think FAR would be making this fuss if they didn't have a backer?? IMO it would be management suicide. They are much,much smarter than this.
Its pretty obvious to me how they could find the money if you use FAR's 2 c 640 mmbbls and FAR was paid $10 bbl for theirs it still only comes to around $4 bbl, $430 + $960 =$ 1.39 / 340 mmbbls with COP's share and you get 50% of the field and Operator ship on DOC + preemptive rights on CNE with no competition from within the JV [ unless Petrosen PE but you would still have rights over the vast % ] all the upside within the leases. Whats not to like about that?? AIMO DB
